Upon signing up for
Caribsurf.net’s services,
all customers agree to comply with
Caribsurf.net’s
Terms of Use. The spirit of this policy is to ensure our customers are
using
Caribsurf.net’s services with due regard to
the rights of other Internet users and in conformity with the requirements
of
Caribsurf.net’s network environment.
Internet web hosting services only
This agreement covers Internet web hosting services only. Not covered
by this agreement are hardware, communication lines and/or software for
access to the Internet, although the Caribsurf.net
can sell those to the client subject to a different contract.
Account sharing
You agree to keep your account information confident. Eastern Caribbean
WebDesign shall not be responsible for lack of privacy, large overtime
bills or any other consequences of account sharing. Sharing of unlimited
accounts is not allowed. Caribsurf.net will cancel
without any compensation any unlimited account used by more than one user
at one time.
Illegal Use
The server space may be used for lawful purposes only. Transmission,
storage, or distribution of any information, data, or material in violation
of any applicable law or regulation is prohibited. This includes, but is
not limited to: copyrighted material; trademarks; trade secrets or other
intellectual property rights used without proper authorization; material
that is obscene, defamatory, constitutes an illegal threat, or violates
export control laws. Examples of unacceptable content or links include:
pirated software, hacker pro-grams or archives, Warez sites, MP3, and IRC
bots.
Adult Content
Due to the special system and network requirements of adult-oriented
sites, pornography and sex-related merchandising are prohib-ited. This
includes sites that may infer sexual content or provide links to adult
content elsewhere. This is also true for sites that pro-mote any illegal
activity or content that may be damaging to our servers or any other server
on the Internet, or provide links to such sites.
Security
Violations of system or network security are prohibited and may result
in criminal and civil liability. Examples include but are not limited to
the following: unauthorized access, use, probing, or scanning of systems
security or authentication measures, data, or traffic; interference with
service to any user, host, or network including, without limitation, mail
bombing, flooding, deliberate at-tempts to overload a system, broadcast
attacks; forging of any TCP-IP packet header or any part of the header
information in an email or a newsgroup posting.
Server Resources
Any web site that uses a high amount of server resources (such as,
but not limited to, CPU time, memory usage, and network re-sources) will
be given the option to either pay additional fees (which will depend on
the resources required), reduce the resources used to an acceptable level,
or upgrade its service to a Dedicated Server plan. Eastern Caribbean
WebDesign shall be the sole arbiter of what is consid-ered to be a
high server usage level.
CGI Scripts
If your account has a CGI script(s) that continuously deemed to be
adversely affecting server performance or network integrity you will be
asked to remove it within 24 hours. If no action is taken we will disable
it. If the script(s) is severely effecting the server we do reserve the
right to disable it immediately.
Chat Rooms
Caribsurf.net does not allow customers to install
their own public chat rooms. Chat rooms tend to require significant system
resources and therefore cannot be permitted as an account option. However,
for a small charge, Caribsurf.net provides Java chat
rooms that meet most users' needs and run without hindering system performance.
IRC
Caribsurf.net does not allow IRC or IRC bots to
be operated on our servers.
UCE (Unsolicited Commerce Email) - SPAM
Spamming, the sending of unsolicited mass email from or through a Eastern
Caribbean WebDesign server or using an email address that is maintained
on a Caribsurf.net machine is STRICTLY prohibited.
Eastern
Caribbean WebDesign will be the sole arbiter as to what constitutes
a violation of this provi-sion. Customers are also in violation of this
provision if they engage in spamming using the service of another ISP or
IPP, but chan-nel activities through a Caribsurf.net
server as a mail drop for responses. Violators will be assessed a minimum
fine of $200 and will face immediate suspension.
Server Abuse
Any attempts to undermine or cause harm to a Caribsurf.net
server or customer are strictly prohibited.
Software Distribution
Caribsurf.net’s shared web hosting accounts are
not configured for the purposes of distributing software and/or multimedia
products. If you wish to distribute software and/or multimedia files, please
contact striewa@t-online.de to make special arrangements.
Multimedia Files
Multimedia files are defined as any graphics, audio, and video files.
Eastern
Caribbean WebDesign shared web hosting accounts are not to be used
for the purposes of distributing and storing unusual amounts of multimedia
files. Any web site whose disk space usage for storing mul-timedia files
exceeds 70% of its total usage, in terms of total size or number of files,
will be considered to be using an unusual amount of multimedia files.
Copyright Violations
The Digital Millennium Copyright Act ("DMCA") sets forth the requirements
for valid copyright infringement notification. If you would like to notify
Eastern
Caribbean WebDesign of an infringement of your copyright, the DMCA
requires that you send your notification to Caribsurf.net.
No returns
Caribsurf.net will not return collected fees for
services.
Cut off period for billing errors
90 days cut off period is set for billing error claims. You agree that
you have no rights to claim any billing errors for period earlier than
90 days from the date of the claim. All bills are final after 90 days.
Right of refusal
Caribsurf.net has the right to refuse services
to anyone.
Price change
Caribsurf.net has the right to change the price
of the services at any time with 30 days notice.
Late Payment
You agree to pay a one time penalty of US$ 5.- per month for delayed
payments.
Terms
You can terminate the services with advance notice in writing only
to Caribsurf.net by mail or e-mail striewa@t-online.de.
You under-stand that there will be no reimbursement and no pro-rate if
you decide to terminate the services before the end of a prepaid term,
regardless of the reason for the termination. Caribsurf.net
can terminate this agreement at the end of a billing period, with a 30
days notice. Caribsurf.net can terminate the agreement
immediately without any compensation if you do not comply with the "Terms
of use" available on-line at this address http://www.caribsurf.net/info/terms.html.
Eastern
Caribbean WebDesign may change its Terms of use at any time without
notice.
Entire Agreement
This Agreement constitutes the entire understanding and contract between
the parties and supersedes any and all prior and contem-poraneous, oral
or written representations, communications, understandings and agreements
between the parties with respect to the subject matter hereof, all of which
representations, communications, understandings and agreements are hereby
canceled to the extent they are not specifically merged herein. The parties
acknowledge and agree that neither of the parties is entering into this
Agreement on the basis of any representations or promises not expressly
contained herein.
Disclaimer
Caribsurf.net will not be responsible for any
damages your business may suffer. Caribsurf.net makes
no warranties of any kind, ex-pressed or implied for services we provide.
Eastern
Caribbean WebDesign disclaims any warranty or merchantability or fitness
for a particular purpose. The includes loss of data resulting from delays,
non-deliveries, wrong delivery, and any and all service interruptions caused
by Caribsurf.net and its employees. Eastern Caribbean
WebDesign reserves the right to revise its policies at any time.
Failure to follow any term or condition will be grounds for immediate
account deactivation.
